The 7th Circuit Court of Appeals has upheld the expanded smoking ban in Marion County. The ruling supports a lower court decision issued earlier this year. The regulations went into effect in 2012 and have been challenged by a group of bar owners in Indianapolis. The group says the expanded ban is unconstitutional and has a negative impact on business.

In its decision, the 7th Circuit says since the initial ban was put in place in 2005, it should have have come as a surprise that the ordinance was expanded.

It also says the injunction sought by the bar owners was “unwarranted.”
