Businesses Prepare For Health Care Ruling

It is a pivotal week for the new federal health care law. The U.S. Supreme Court could rule on the constitutionality of the act as early as today. Ice Miller Partner Greg Pemberton focuses on health care and says businesses should be prepared for a two-phased approach once the ruling comes down, which includes a cost-benefit analysis and a decision on whether employees should be shifted to a health care exchange. Pemberton discusses the options with the Business of Health's Barb Lewis.

Pemberton says there appears to be three options before the court.

The justices could uphold the law, strike down the entire act, or deem parts of it unconstitutional.

He says most observers are expecting the requirement for everyone to purchase health care insurance or face a penalty will be deemed unconstitutional.

If the high court does not issue a decision today, the next option for a ruling is expected to be Thursday.
